We are happy to represent any party in insolvency proceedings. Not only do we act for office holders but also for directors, shareholders, sole traders, debtors and creditors. Acting for office holders we have brought successful claims in respect of transactions at undervalue, preferences, and transactions putting assets beyond reach of creditors. Other successful claims have included recoveries to creditors from wrongful trading and other breaches of the insolvency legislation.
We have advised directors facing disqualification proceedings and debtors facing bankruptcy or winding-up petitions. We have petitioned on behalf of creditors for bankruptcy and winding-up of individuals, partnerships and limited companies.
